POSH Internal Committee Setup Checklist

Use this to audit an existing Internal Committee, or as a setup guide for a new one. Composition is where most companies fall short — start there.

Composition

A Presiding Officer is a senior woman employeeAt least two other members are employees with legal knowledge or commitment to women's issuesAt least one external member is genuinely from an NGO or has relevant legal expertise — not an internal employee filling that roleAt least half of the total members are women

Documentation

The IC's constitution is formally recorded (board resolution or equivalent) and datedA written POSH policy exists and is distributed at onboardingCommittee members' names and contact details are displayed/communicated to all employees

Operating Process

Quorum requirements for a hearing are defined in writing, including external member participationThe 90-day statutory timeline for completing an inquiry is tracked against every open complaintConfidentiality obligations under Section 16 are explained to committee members, not assumedA written record-keeping process exists for complaints, hearings, and outcomes

Ongoing Compliance

An annual report on POSH complaints is prepared (required for inclusion in the company's annual report where applicable)Committee composition is reviewed at least annually for member turnoverRefresher training is conducted for committee members at least annually
